Public Hearing on the Bangsamoro Basic Law
Sixteenth Congress

First of all, I would like to thank the ad hoc Committee on the Bangsamoro Basic Law for the honor of having been invited to this hearing.

This is indeed a unique opportunity for the Sixteenth Congress to contribute a historic milestone – lasting peace and justice for our Muslim brothers and sisters, as well as for the whole of Mindanao.  I support the Bangsamoro Basic Law, because it reflects the intent and provisions of the 1987 Constitution.

As we know, the Preamble of our Constitution aspires “to build a just and humane society” and to ensure “a regime of truth, justice, freedom, love, equality and peace.”  Our Constitution seeks to redress the injustices long suffered by the marginalized, as a result of their inadequate access to political and material resources of society.

The Bangsamoro Basic Law pulls the nation away from the battlefield and seeks to eventually realize the evasive peace imperative. It promises to usher in human and economic development — the dream of every Muslim, Christian and indigenous Filipino not only in Mindanao but in the entire Philippines. Its success will be one of the greatest achievements of the Philippines– the fruition of a model of regional autonomy that neighboring countries can emulate. Most of them have sizeable minority populations, such as China, Indonesia, Thailand, Cambodia, Laos, Myanmar and Viet Nam, and they await with much anticipation the outcome of the draft BBL.

In evaluating the Bangsamoro Basic Law, we should not be bound by extreme legalism, much less by our vested interests or by our prejudices and fears. We must look at the big picture and ponder on the long-term effects of our decision.

We should not regard the Bangsamoro government as just another local government unit. As provided in Article VI, “Intergovernmental Relations”, “the relationship between the Central Government and the Bangsamoro Government shall be asymmetric. This is reflective of the recognition of their Bangsamoro identity, and their aspiration for self-governance. This makes it distinct from other regions and other local governments (Section 1).”

There are a few who are afraid that the BBL is a mere stepping-stone to secession. They think that self-determination necessarily carries with it the right to become a national state with independence and sovereignty. We must not forget, however, that the applicable principle invoked in the case of the Bangsamoro government is the internal right to self- determination, which entails only self-governance and not independence.

The proposed Bangsamoro government is not a state or a semi-state.  Autonomous areas do not possess sovereignty and independence, which are essential elements of a state. Article III of the BBL entitled “Territory” declares that “The Bangsamoro territory shall remain a part of the Philippines.”

In international law, autonomous areas “are regions of a State, usually possessing some ethnic or cultural distinctiveness, which have been granted separate powers of internal administration, to whatever degree, without being detached from the state of which they are part.” (J. Crawford, The Creation of a State in International Law 211-212 (1979). See also Hurst Hannum and Richard B. Lilich, “The Concept of Autonomy in International Law.” American Journal of International Law. Vol. 74, no. 4 (October 1980). 858- 889.) Because they do not have a foreign-relations capacity, the authority of autonomous regions is of necessity limited.

In Article V, “Powers of Government,” the Reserved Powers pertain to matters over which authority and jurisdiction are retained by the Central Government: defense and external security, foreign policy, coinage and monetary policy, postal service, citizenship and naturalization, immigration, customs and tariff as qualified by Section 2 (10) of the Basic Law, common market and global trade, provided that the power to enter into economic agreements given to the ARMM under R.A, 9054 is hereby transferred to the Bangsamoro Government as provided in Article XII, Section 25 of the Basic Law, and intellectual property rights.

The provision on regional autonomy in the 1987 Constitution   addresses the responsibility to redress the humiliation, deprivation and prejudices suffered for centuries by our Bangsamoro brothers and sisters since the days of foreign colonization.  We have the moral obligation to put in place the much-needed institutions to avoid the mistakes of the past, and to chart a better destiny for our nation. It is more than a mandate of our fundamental law; it is the duty of our present generation to our children and grandchildren.  Cognizant that the Philippines is a war-weary nation which has been dragged to engage in armed conflicts not of its own making, the framers of the 1987 Constitution enshrined in Article II of the Declaration of Principles and State Policies that: “The Philippines renounces war as an instrument of national policy, adopts the generally accepted principles of international law as part of the law of the land and adheres to the policy of peace, equality, justice, freedom, cooperation, and amity with all nations (Section 2).”

At this juncture of our history, do we have a choice? Do we want Southern Philippines to become a wasteland ravaged by war, or do we want it to be the catalyst in fulfilling the dream of all Filipinos to be at the forefront of growth in ASEAN?

Now that we have gone this far in striking a landmark agreement with the Muslims, the lumads and the Christians in Bangsamoro areas, let us be just and magnanimous in allowing them the fullest possible autonomy. Let us secure the peace. Let us seize the moment!

Thank you for this privilege.

I am grateful to join the vanguards of the Model United Nations in this gathering, especially our young awardees who are marked to eventually lead the ranks of the foreign service.  Congratulations!

I am informed that Saint Benilde was beatified in 1948 for serving God by doing common things in uncommon ways.  We extol him today as we strive with all our might to build one world on the firmament of peace.

I am glad we are celebrating the idea of a common heritage for sustainable peace and development. For our commonality is the moving force of this event, as we share one voice, one mind and one spirit to express our embrace of peace as the overarching force that shapes the future of humanity.

Peace is not merely the road to a better life, peace is life itself.

And this is not the peace that comes all of a sudden and out of nowhere. It is the peace that has been molded in our homes since we were children, nurtured in us by the grand experience of being in real communities and progressive societies—a peace carried forward by the strong will of nations, leaders and constituencies.

Ours is the peace that is founded on universal human security—cherished, held tight and defended by true fighters and believers —universal because it applies to each and every person who is brought to life on this earth, to each and every race and nation built upon the pillars of human freedom and dignity.

The world is changing in ways we have never imagined.

Progress and prosperity have grown by leaps and bounds, but so has the scourge of hunger and disease deepened amongst the poor.

Peace has evolved from conflict in many places, but new conflicts have also emerged out of contravening ideologies.

Climate change has only magnified the disparity among nations, in terms of capacity and material resources, to wage peace and development.

For every nation, the task has correspondingly become more complex and challenging, imposing the daily grind of sacrifice and toil that each and every one of us is called upon to bear for the sake of the common welfare.

Waging peace is not simply negotiating an end to war.

It is the endless effort to discover the tranquil  middle ground between a clash of cultures and beliefs; to test the limits of human tolerance, understanding and accommodation; and to explore the flexibilities that can be leveraged from the established rules of governance—the Constitution and the laws.

Waging peace is not only finding the harmonic chords that foster broader political and economic equality, but finding the right political and economic niches for those in dire need of better health, deeper knowledge, work, respect and dignity.

We know only too well that in facing these challenges, no nation is an island unto itself; and as the poet said: “We are all part of the main.”

And in bringing the world closer together for peace, foreign policy and strategy are indispensable tools of every nation.

I trust that in the past four days, you have learned to wield these tools in the manner of budding diplomats, negotiators, strategists and leaders.

You are our hope for the future!

In the case of Mindanao, our foreign policy has driven us to seek the working consensus of good neighbors, Malaysia and Indonesia, to push understanding and settlement forward.

We have leveraged on international  support to gather the best practices of the world behind our own efforts.

For many years, hundreds of meetings and roundtables, seminars and training sessions have been held in many countries on almost all aspects of the peace process—from culture and education, ceasefire monitoring and management, community development, governance capacity building, among other equally important fields.

We have called upon the great powers and institutions to pour in technical aid and resources, participate in crisis management and lend their trust and moral support.

The world has been a rallying force that has kept both parties—the government and MILF—committed to win the peace at all costs, as we have so won.

The world has stood unwaveringly behind President Aquino and his staunch leadership and ironclad will.

The somber pall has started to lift in the conflict ridden areas of Mindanao.

If you travel there today you will see more smiles on people’s faces as the burden of fear has slowly given way to the waft of confidence. You will see new farms being tilled and sown by former combatants who have left their guns for ploughshares. You will hear the shrill voices of children bustling in distant school grounds that were once evacuation sites.

Go there and experience the real signs of peace that are rising from the land.

Only last week we held the first Philippine Development Forum in the Bangsamoro in Davao City, where, led by President Aquino, we took up the first development blueprint of the entire region designed and written by the MILF.

The Plan is comprehensive, far reaching and inclusive. It is designed not only to bring former combatants into a life of normalcy, but bring whole communities to the edge of prosperity.

You would have been happy to be there in that forum, because it also featured the work of the international community in helping orchestrate the tasks of peace and development as a joint enterprise of the government and the MILF.

You would have been happy to know that both sides have agreed to become active players in the global stage by jointly taking the challenge of human development, gender, environment, and food security, among others.

The World Bank, Japan International Cooperation Agency, UN and other friends and allies across the globe were there with us.

We recall the time, almost half a century ago, when we were in such despair of reaching an end to war.

Now the war is done, and national consolidation is taking its place.

We marvel at the pace at which events have been moving at speed.

We signed a historic peace pact with the Moro Islamic Liberation Front (MILF) early this year. That agreement has been written into a piece of legislation called the Bangsamoro Basic Law (BLL). Our senators and representatives are currently deliberating on it. Consultations with stakeholders have been broad and deep—not solely within the confines of the legislature, but with the people in the provinces and islands across Mindanao.

The BBL—once passed by Congress and ratified through a plebiscite—shall give rise to the enhanced autonomous Bangsamoro region by 2016. A ministerial form of government shall be in place led by a chief minister, under the supervision of the President of the Philippines, under one Philippine Flag and within the ambit of our Constitution.

As the Philippine Congress is working on the BBL, the normalization process is underway. Normalization speaks of enabling conflict-affected communities in Mindanao to return to peaceful, productive lives.

International partners remain beside us in this effort of turning the climate of fear into a climate of enterprise.

The negotiating panels have formed an Independent Decommissioning Body (IDB) tasked to conduct the phased decommissioning of MILF forces and weapons and put them beyond use. Together with four local experts, Brunei, Turkey and Norway complete the seven-member body.  Once the guns are gone, we shall have more abled bodied men and women to drive productivity and prosperity.

Aside from the IDB, other mechanisms are also in place to facilitate normalization, namely the Joint Normalization Committee; the Joint Peace and Security Committee; the Interagency Task Force tasked to transform MILF camps into peaceful and productive communities

The Transitional Justice and Reconciliation Committee, chaired by a Swiss national,  is meant to address legitimate grievances of the Bangsamoro people, correct historical injustices, and address human rights violations of the past.

No one shall be left behind in the march of inclusive growth and social justice—Muslim, Christian, and Lumad.

With its strategic location, the Bangsamoro shall play an integral role in regional trade and cultural exchange in the context of the forthcoming ASEAN integration next year.

The creation of the Bangsamoro foresees an influx of investments—propelling development, jobs, and social equity.

And, in light of the growing threat of Islamic extremism, the Bangsamoro will eventually help mop up the marginal pockets of terror that have aggravated the dark climate of conflict and strife.

All these developments have brought us within the cusp of shared security and prosperity in the Philippines, eventually transcending our borders and reaching out to the regional community, and even to the rest of the world.

Through the Bangsamoro, we shall not only restore meaningful and genuine autonomy, we shall restore the people’s trust in the strength of our Constitutional system.

In a sea of conflicts around the world, the Philippines shines as a “bright spot for peace.”

As future diplomats, you must carry the seed of peace to other nations and enable it to take root and grow.  A million others will join you in your noble quest.

Help us build a nation and a world where violent conflict is defeated under the weight of our common struggle, our common heritage.

Help us champion peace in the heroic and uncommon ways that only Saint Benilde would have done in his blessed life.

Help us win the peace. Because when peace wins, we shall conquer fear and poverty.

Translation: On the CBCP President’s November 10 Message

Hindi iminungkahi ng Negotiating Panel ng National Democratic Front of the Philippines (NDFP) ang presidente ng Catholic Bishops’ Conference of the Philippines (CBCP) na mamagitan sa negosasyong pangkapayapaan sa pagitan ng Gubyerno ng Pilipinas (GPH) at ng NDFP. Mahigpit na patakaran ng NDFP na huwag ipagkatiwala sa anumang entidad ang kapangyarihang mamagitan sa negosasyong pangkapayapaan. Ang kapangyarihang arbitrayong magdesisyon at ipataw ito sa mga Partido sa negosasyong pangkapayapaan ay maaaring mangahulugan ng panganib sa rebolusyonaryong kilusan at mamamayan. Kaya, ang Royal Norwegian Government (RNG), na iminungkahi kapwa ng GRP/GPH at ng NDFP na tumulong sa negosasyong pangkapayapaan, ay imunungkahing lamang na maging Ikatlong Partidong Tagapagpadaloy.

Nang sabihin ng presidente ng CBCP na “mungkahing mamagitan sa pag-uusap ng gubyerno-NDF”, ang gayong mungkahi ay hindi kailanman nanggaling sa NDFP. Ang mungkahi para sa isang ikatlong partido na gumampan ng papel sa negosasyong pangkapayapaan ay dapat gawin ng magkabilang Partido. Dapat ding pagkasunduan ng kapwa Partido kung anong tipo ng papel ang gagampanan ng ikatlong partido sa negosasyong pangkapayapaan.

Dapat ilinaw sa Presidente ng CBCP na nakabase sa Pilipinas ang rebolusyonaryong pamunuan. Inatasan ang Negotiating Panel ng NDFP ng rebolusyonaryong pamunuan na makipag-usap para sa kapayapaan sa ngalan ng mga rebolusyonaryong pwersa. Ang kumand at pamumuno ng rebolusyonaryong pakikibaka ay ginagawa sa Pilipinas.

Kaugnay sa negosasyong pangkapayapaan, kung may panukala na isang kasunduan para sa isang pansamantalang tigil-putukan upang itaguyod ang usapang pangkapayapaan, nagrerekomenda ang Negotiating Panel ng NDFP sa rebolusyonaryong pamunuan para sa implementasyon ng gayong tigil-putukan. Halimbawa, noong Disyembre 18, 2012, nagtagpo ang magkabilang panig sa The Hague kasama ang tagapagpadaloy mula sa RNG, mayroong panukala na magkaroon ng magkatugong tigil-putukan sa loob ng 27 araw. Ipinarating ng Negotiating Panel ng NDFP ang panukalang ito sa rebolusyonaryong pamunuan sa Pilipinas. Kaya naipatupad ang isang 27-araw na tigil-putukan umpisa Disyembre 20, 2012.

Nakagawa ng malaking pagkakamali ang presidente ng CBCP, sa pag-akusa sa Bagong Hukbong Bayan na pasanin ng mamamayan sa kanayunan. Naglulunsad ang BHB at iba pang rebolusyonaryong pwersa ng maka-mamamayang progrma ng reporma sa lupa, kalusugan, edukasyon kabilang ang literasiya at pagbilang, kultura at pagtatanggol-sa-sarili. Nagreresulta ang mga programang ito sa pagpapabuti ng buhay ng milyun-milyong mamamayan. Kaya, minamahal ng taumbayan ang BHB bilang kanilang hukbo, sa pagtatanggol sa kanilang mga karapatan at programa. Ang gayong pag-akusa na nagmumula sa panel sa negosasyong pangkapayapaan ng GPH ay pagbaluktot sa katotohanan. Batid ng mga lider ng simbahan at iba pang taong-simbahan, na malapit sa nakikibakang mamamayan, na mali ang alegasyon mula sa panel sa negosasyong pangkapayapaan ng GPH.

Mariin naming pinasisinungalingan ang alegasyon na walang sustantibong ibinunga ang negosasyong pangkapayapaan. Ang The Hague Joint Declaration bilang balangkas ng negosasyong pangkapayapaan, Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) at ang iba pang saligang kasunduan ay mga signipikanteng resulta. Kinilala ng ibang bansa ang mga ito, kaya nagkaroon ng dalawang resolusyon ang European Parliament na nag-endorso rito.

Kinalulugdan ng Negotiating Panel ng NDFP ang mga lider simbahan na nag-imbita sa amin nang bumisita kami sa bansa. Ikinasisiya namin ang kanilang mapagkaibigang kondukta. Nang sila’y bumisita sa International Office ng NDFP, sinalubong at inistima namin sila. Naniniwala kami na ang ganitong mapagkaibigang interaksyon ay makatutulong sa magkabilang panig at makatutulong sa pagpapayabong ng diwa na pabor sa pagsusulong ng mga hakbang para makamit ang isang makatarungan at pangmatagalang kapayapaan sa ating bansa.

Ikinalulugod namin ang tuluy-tuloy na pagsisikap na magpunygai para sa isang makatarungang kapayapaan ng Philippine Ecumenical Peace Platform (PEPP), ng Ecumenical Bishops’ Forum (EBF), ng Pilgrims for Peace, ng Sowing Seeds for Peace at ng KAPAYAPAAN Campaign for Just and Lasting Peace, na may mga prominente at makabuluhang lider simbahan. Ang panawagan ng mga tagapagtaguyod ng kapayapaang ito na umaakto bilang “mga tagapanday ng tulay para sa kapayapaan” na ipagpatuloy ang usapang pangkapayapaan, kilalanin ang lahat ng kasunduan, at harapin ang mga ugat ng armadong tunggalian, ay isang kaaya-ayang positibong tulak para isulong ang negosasyong pangkapayapaan upang makamit ang isang makatarungan at pangmatagalang kapayapaan.
